* GENERAL TERMS: A 10% Buyer Fee Per Lot is added to High Bid and becomes the contract purchase price. All animals are being offered AS IS, WHERE IS, No Warranties, No Guarantees, No Refunds. RELEASE OF ANY ANIMAL TO A BIDDER, EVEN THOUGH A PAID INVOICE IS PRESENT, IS SUBJECT TO THE SOLE DISCRETION OF THE PARKER COUNTY ANIMAL CONTROL SUPERVISOR, Hereinafter 'PCACS'. WINNING BIDDERS MUST PROVE TO THE PCACS AS TO THEIR KNOWLEDGE IN TRANSPORTATION AND CARE OF THE ANIMAL BEING RELEASED. THE PCACS RETAINS THE RIGHT TO CANCEL THE TRANSACTION AT HIS/HER SOLE DISCRETION, FOR ANY REASON, AND MAY ORDER A FULL REFUND OF AN INVOICE. IT IS THE INTENT OF THE PCACS TO RELEASE THESE ANIMALS ONLY TO A SUITABLE OWNER/ENVIRONMENT WHERE THEY MAY BE TREATED HUMANELY AND KEPT IN GOOD CARE. Any animal may be redeemed by registered owner prior to close of auction. Buyers assume all responsibility and hold Seller and Auctioneer harmless for introducing any animal or animal part into the stream of commerce. All Invoices are Due and Payable upon receipt. A paid invoice receipt from Texas Auction & Realty is required for pickup and removal. Photographs and Descriptions are provided as a guide, and a guide only. Descriptions are provided by Weatherford-Parker County Animal Shelter. Bidders to verify correctness of ANY advertised information to their satisfaction as to use for any particular purpose. All bidding is based upon the Bidders Personal Inspection and Opinion. IT IS THE SUCCESSFUL BUYERS SOLE RESPONSIBILITY TO DEMAND A NEGATIVE COGGINS TEST RESULT FROM THE WEATHERFORD/PARKER COUNTY ANIMAL SHELTER PRIOR TO REMOVING ANY EQUINE FROM THE PREMISES.

* PREVIEW & INSPECTION:
Animals are located at the Weatherford-Parker County Animal Shelter , 403 Hickory Lane, Weatherford TX. PREVIEW BY APPOINTMENT WITH THE ANIMAL SHELTER, DURING NORMAL BUSINESS HOURS. The Animal Shelter is Open to the Public Tuesday thru Saturday, 11am to 4pm. Phone 817-597-1030 for other arrangements.

* INVOICES & PAYMENT TERMS: All Invoices are due and payable upon receipt. Buyer authorizes Ross Bandy Auctioneers, LLC dba Texas Auction & Realty to charge buyers credit card to pay invoices up to $2,500. A Cashiers Check will be required for invoices over $2,500. You may pay in Cash before you pickup your items. If you have a preference in how you wish to pay, please let the Auctioneer know before the auction ends! Otherwise, all cards will be charged after the conclusion of the online auction.
In ALL instances, payment must be received within 48 hours after the close of the online auction, unless other arrangements have been made. No sale is final until payment has been made and accepted within these guidelines. The Weatherford Parker County Animal Shelter DOES NOT Accept Payments from winning bidders.

PICK UP TIMES / REMOVAL TERMS: By APPOINTMENT ONLY!
Pickup and Removal are BY APPOINTMENT with the PCACS by phone 817-597-1030, after payment has been made, and during the normal business hours of the Animal Shelter. WINNING BIDDERS MUST HAVE A COPY OF THEIR INVOICE AND VALID IDENTIFICATION TO PICK UP ITEMS!! If someone other than the winning bidder will be picking up the merchandise, please send a copy of winning bidders ID and a letter or permission stating that they can pick up the merchandise. The person picking up the merchandise will be required to show identification.

* EXTENDED BIDDING / DYNAMIC CLOSING: If a bid is entered within the last five minutes of the closing of an item, the closing time will be extended by five minutes to ensure sufficient time for bidders to submit their bids. Extended Bidding will continue until bidding has ceased.

All persons previewing, removing, or on the premises for any reason, assume all responsibility for their own safety. Auctioneer & Seller are not responsible for accidents.

All items sold 'As-Is, Where Is', no warranty or guarantee of any kind. All sales are final. No returns or refunds. All descriptions are believed to be accurate, however, all bidding and buying is based solely on bidder's personal inspection and/or opinion of the items.

It is the Bidders/Purchasers sole responsibility to:
(a) perform all inspections of the items and to be satisfied as to its description, condition and/or authenticity prior to bidding.
(b) independently verify any information they deem important including information available.
(c) all information contained in the item description and all promotional materials, including, but not limited to, photographs, dimensions, conditions, etc., was provided by or on behalf of the Seller and is believed to be correct, however, neither the Seller nor the Auction Company makes any promise, representation, guarantee, or warranty as to the accuracy or completeness of such information. Bidders must rely solely on their own inspection as to the accuracy of the photographs or other information provided.
(d) failure to inspect the property does not relieve bidder of responsibility for payment and removal as stated in these terms.
All Bids Are A Binding Contract. Bidder acknowledges that once a bid is offered, the Bidder shall be bound by the bid amount. Bids cannot be withdrawn or retracted. Verify your information entered (bid amount) before submitting your bids.
Buyer is responsible for the items once bidding is complete. Seller, nor Auction Company are responsible for the items.
Items subject to additions and or deletions prior to sale time/closing.
Texas Auction & Realty makes no warranty that:
(a) your use of the site will be uninterrupted, timely, secure, or error-free.
(b) the results that may be obtained from the use of the site will be accurate or reliable.
(c) the quality of any information or other material obtained by you through the site will meet your expectations.
(d) the use or the inability to use the site; unauthorized access to or alteration of your transmissions or data; statements or conduct of any third party on this site; or any other matter relating to the site.
In case of any errors or malfunctions of hardware or software, Texas Auction & Realty reserves the right to cancel any transaction even if you have received confirmation of the transaction by email.
We strive to make this system as stable as possible, however errors and equipment malfunctions are possible and may happen without notice. We cannot and will not guarantee uninterrupted access to the Site or its services.
Buyer is responsible for the physical labor for dismantling, rigging, crating, loading and hauling at their own expense. Buyer is responsible for the items once bidding is complete. Sellers, Auction Company, and Staff are not available for load out.
